Terms and Conditions

These Terms and Conditions cover the return and sale of clothing items ("Items") via a SWISH bag. SWISH is the trading style of Green Heart Collective Ltd ("the company", "our", "us") and your agreement is with the company. The company works with online "stores" (those who sell or market clothes), "charities" (those who will benefit from the sale of the supplied items) and "you" (someone who sends in a SWISH bag containing their unwanted Items) the current owner of preloved Items.

Our overriding aim is to reduce waste by diverting clothing items from landfill and that principle guides all that we do.

1.0 Getting a SWISH Bag

A SWISH bag can be supplied by a merchant you are buying from, a charity you wish to support or directly from the Green Heart Collective website. You can also collect a bag directly from Green Heart Collective during normal working hours. Any costs in getting a SWISH bag to you may be removed from any payout or charity donation that your items achieve. However, in most cases, your SWISH bag will be sent to you for free.

2.0 Filling your SWISH bag with items to send in

While we accept clothes from any brand, items from one of our focus brands will generally get a quicker sale and a higher payout. You can see a full list of our focus brands here.

All items must meet the following criteria:

  • Be in excellent condition - free from any damage, rips or tears. Free from bobbling, pet hair, stains, discolouration and alteration from how the original item was sold.
  • Be an original - please do not send us copies or fakes.
  • Be recently cleaned, from a Smoke free home, and free from any harsh odours, dust, damp or mildew.
  • Be an adult women's or men's garment.

Please pack the items in the mailer bag making sure that it does not weigh more than 15kg and that it will fit in the maximum locker size of 41cm x 38cm x 64cm. Using the SWISH bag supplied will make sure you fit within the given dimensions. Please seal the bag carefully - fold over the open end of the bag tightly and use the sealing strip. No need for extra tape - we reuse all bags returned to us.

Once an item has been sent to us, it cannot be returned in any circumstance. so please choose your items carefully.

3.0 Register your SWISH bag

Before you can return the SWISH bag, you will need to register the bag using the QR Code on the front of the bag. Scan the code and you will be taken to the SWISH website at swish.plus. You will need register yourself if you haven't used the service before. Your registration is subject to our Privacy Policy.

You will need to provide an email and phone number so we can update you on the progress of your SWISH bag and its contents.

Once you have registered and confirmed you accept the terms and conditions, you will be provided with a Inpost QR code. This will also be sent to your email and mobile phone.

4.0 Return your SWISH bag to us

Find your most convenient Inpost locker - you can find your nearest locker using this link - and once you arrive, follow the instructions on the screen. Scan the Inpost QR Code on your phone screen - a copy of the QR Code will have been emailed to you. You will be asked to select the size of the locker you need, then the door will open, and you can place the SWISH bag in the locker. Close the door carefully and confirm on the screen that you have stored your SWISH bag. For extra peace of mind, you can scan the QR Code on the screen to get an update when your bag is delivered to us. However, you will automatically get updates using the details you provided when you registered the bag.

As detailed in section xx, each returned SWISH bag returned via Inpost will have a fixed fee removed from items in the bag. If you would prefer to return a bag in person or using Royal Mail, simply drop it off or send it to SWISH, Unit 4, Perth Court, Eleventh Ave North, Gateshead NE11 0NJ at your own expense.

5.0 Receiving your bag

We will process your bag within 4 weeks of it arriving at our warehouse, usually within a week, but do allow longer as busier times of the year. Details of the status of your bag can be found in your SWISH account dashboard.

As we process your bag, each item will appear on the dashboard with the details we have added as it proceeds through our quality checking and upload process.

If an item does not meet our quality criteria as outlined in Section 2.0, then it will not be listed and will be passed on to one of our charity partners where it may be sold or used directly for their charitable aims. In this case, you will not receive any rewards for sending that item in.

Once the checks and listings are complete, you will see what we will initially aim to sell your item for. Please note this is the gross amount and VAT, customer postage and fees will be removed from that amount. Please see section xx for details of the fees.

6.0 Promoting and selling your items

As we share the proceeds of the sale with you and where applicable, your charity partner, it is in our interests to maximise the value of the sale. However, we aim to sell all items within 90 days of receipt and so we will promote your items as appropriate and will use offers and discounts so that it does find a new home. Any promotions and discounts are solely at our discretion. We will provide you with details of where your items are on sale and you can also promote your items yourself - on your own social media for example.

Once your item sells, we will begin the process of reconciling payments and rewards for all those involved in the proceeds from your item. Section xx details how we calculate your rewards.

Any marketing costs, platform fees, credit card charges, relevant taxes will be paid by us and will not be deducted from the Net Remaining Amount

7.0 Sharing the proceeds of the sale

Each SWISH bag is associated with an online merchant or charity. At the point of registration, you can opt to share some or all of the proceeds with your nominated charity. Once a bag has been registered, this association cannot be changed, and the rewards will be shared as you specified.

Once your item(s) has been accepted, a fixed fee of £4.40 covering the Inpost cost and packing costs is shared across your items. This is the per Item Inbound Charge.

When an item sells, we will deduct from the gross proceeds:

  • Any VAT due
  • Item Inbound Charge
  • Outbound Postage cost share (if applicable) for sending the Item out.

After these charges, the net remaining amount will be shared equally with us and you and/or your chosen charity. Anything due to you directly will be shared as reward benefits with your chosen merchant. If no merchant was set when you received the bad, you can spend your rewards on items from Green Heart Collective online or in person. Please allow up to four weeks to be notified that your reward is available. Any amount due to your chosen charity will be paid in cash quarterly on the 1st day of the month.

Many of the costs are fixed, so if the item sells for £7.00 or lower, then there will be no reward pay out to you or your charity.

For example, if you send five items in a bag and they all sell for £12 each then following payout summary would be generated:

8.0 Your warranty to us

You warrant that the following is true and that by sending items to us, you are confirming:

8.1 you fully own the Items being sold and/or donated under these Terms and Conditions or you are authorised to sell and/or donate the Items by the owner;

8.2 you are transferring full ownership to Us and the Items are free from any third party claims or liabilities. For example, if you have bought them using instalment billing or other credit mechanism, you are confirming that it has been fully paid and there are no explicit or implicit claims relating to the ownership the Items;

9.0 General Terms

9.1 Nobody else has any rights under these Terms and Conditions. The Terms and Conditions are between you and us. No other person shall have any rights to enforce any of the terms described here.

9.2 You need our consent to transfer your rights under these Terms and Conditions to someone else. You may only transfer your rights or obligations under the Terms and Conditions to another person if we agree to this in writing.

9.3 The Terms and Conditions can only be varied by written agreement between us and you. No variation of the Terms and Conditions is effective unless in writing and signed by the parties or their authorised representatives.

9.4 If a court finds any part of these Terms and Conditions illegal, the rest will continue in force. Each clause of the Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.

9.5 The Terms and Conditions are governed by English law, and you can bring legal proceedings in respect of the Terms and Conditions in the English courts.
